Section 280

Section 280 If the commission of the offence under Section 278 or Section 279 causes the victim:

(1) to suffer grievous bodily harm, then the offender shall be liable to imprisonment for a term of 5 years to 20 years and to a fine of 100,000 Thai baht to 400,000 Thai baht or to imprisonment for life.

(2) to die, then the offender shall be liable to a death penalty or imprisonment for life.

Section 287/1

Section  287/1  Whoever possesses child pornography for the sexual benefit of themself or of any other person shall be liable to imprisonment for a term not exceeding 5 years or to a fine not exceeding 100,000 Thai baht or to both.

If the person committing the offence under Paragraph 1 forwards child pornography to any other person, he or she shall be liable to imprisonment for a term not exceeding 7 years or to a fine not exceeding 140,000 Thai baht or to both.

Section 287/2

Section 287/2 Whoever

(1) for the purpose of trade or by trade or for public distribution or exhibition, makes, produces, possesses, imports or causes to be imported into the Kingdom, exports or causes to be exported out of the Kingdom, takes away or causes to be taken away or propagates by any means any child pornography;

(2) engages in the trade of or participates in the trade of child pornography, distributes or publicly exhibits child pornography, or rents out child pornography;

(3) for the purpose of propagating or trading of child pornography, advertises or propagates by any means the existence of a person committing an offence specified in this section or advertises or propagates how to obtain or from whom to obtain child pornography

shall be liable to imprisonment for a term of 3 years to 10 years and to a fine of 60,000 Thai baht to 200,000 Thai baht.

Offenses Defined in the Child Protection Act of B.E. 2556 (2013)

Section 26

Section 26 Under the provisions of other laws, regardless of a child’s consent, whoever commits any of the following acts:

  1. committing or omitting acts which result in torturing a child’s physical or mental state;

  2. intentionally or negligently withholding things that are necessary to sustain the life or health of a child under their care to an extent which will likely cause physical or mental harm to the child;

  3. forcing, threatening, using, inducing, or allowing a child to behave inappropriately or to be the likely cause of wrongdoing;

  4. advertising by means of mass media or information dissemination to receive or give away a child to anyone who is not the child’s relative, unless such action is done by the State or is approved by the State;

  5. forcing, threatening, using, inducing, allowing, or acting in any other way which results in a child becoming a beggar, a vagrant, or an instrument for begging or committing crimes, or acting in any way which results in the exploitation of the child; 

  6. using, employing, or asking a child to work or acting in such a way which will likely cause physical or mental harm to, affect the growth of, or hinder the child’s development;

  7. forcing, threatening, using, inducing, encouraging, supporting, or allowing a child to play sports or committing any acts indicative of commercial exploitation in a manner which hinders the growth or development of a child or in a manner which tortures the child;

  8. using or allowing a child to gamble in any form or to enter into a gambling place, brothel, or other places where children are not allowed;

  9. forcing, threatening, using, inducing, encouraging, supporting, or allowing a child to perform or act in a pornographic manner, regardless of whether the intention is to obtain remuneration or for any purpose;

  10. selling, exchanging, or giving liquor or cigarettes to a child, unless it is for medical treatment;

if the offences listed under Paragraph 1 carry heavier penalties under other laws, then the penalties under such law shall be imposed.
