Physical Harm
Section 278
Section 278 Whoever commits an indecent act upon a person over 15 years of age with any kind of threat, with an act of violence, when the subjected person is in a condition of being unable to resist or by making the subjected person mistake the offender for another person, the offender shall be liable to imprisonment for a term not exceeding 10 years or to a fine not exceeding 200,000 Thai baht or to both.
Section 279
Section 279 Whoever commits an indecent act upon a child not over 15 years of age, regardless of the child’s consent, shall be liable to imprisonment for a term not exceeding 10 years or fined no more than 200,000 Thai baht or both. However, according to Paragraph 3 of Section 279, if this offence is committed with any kind of threat or with an act of violence, when the subjected child is in a condition of being unable to resist or by making the subjected child mistake the offender for another person, the offender shall be liable to imprisonment for a term of 1 year to 15 years or to a fine of 20,000 Thai baht to 300,000 Thai baht or to both.
Section 280
Section 280 If the commission of the offence under section 278 or section 279 causes the victim:
(1) to suffer grievous bodily harm, then the offender shall be liable to imprisonment for a term of 5 years to 20 years and to a fine of 100,000 Thai baht to 400,000 Thai baht or to imprisonment for life.
(2) to die, then the offender shall be liable to a death penalty or imprisonment for life.
Section 280/1 If the person who committed an offence specified in Section 276, Section 277, Section 278 or Section 279 has visually or audibly recorded the sexual act or indecent act in order to seek illegal gains for themself or for any other person, then the offender shall be liable to a heavier punishment by one-third the amount provided in those sections.
